Kenya Court Halts U.S.-Linked Ebola Facility Plan

Kenya’s High Court has temporarily blocked a proposed U.S.-linked Ebola quarantine and treatment facility following a petition filed by the Katiba Institute, a Kenyan civil society and constitutional watchdog group.

In interim orders issued on May 28, the Milimani High Court barred Kenyan authorities from “establishing, operationalizing, facilitating, approving or permitting” any Ebola exposure, quarantine, isolation or treatment facility connected to arrangements with the United States or any foreign government pending further hearings.

The court also restrained authorities from admitting into Kenya or transferring persons exposed to or infected with Ebola under the proposed arrangement.

The Katiba Institute argued in court filings that the proposed arrangement posed risks to public health and national sovereignty. The court directed the respondents to file responses within 48 hours and scheduled further directions for June 2.

International media outlets including Reuters and CBS reported that the proposed facility was intended primarily for Americans exposed to Ebola in Central Africa as part of outbreak preparedness and evacuation logistics.
